These Terms of Use govern your access to and use of the Esteem Compression Apparel website located at https://www.esteem-compression-apparel.com (the “Site”).

The Site is owned and operated by A & J MERCHANDISING LTD. Esteem Apparel is a registered trademark and brand of A & J MERCHANDISING LTD. By accessing or using this Site, you agree to be bound by these Terms of Use. If you do not agree, do not use the Site.

We may update or revise these Terms of Use at any time without prior notice. Your continued use of the Site after any changes are posted means you accept those changes. As long as you comply with these Terms of Use, Esteem grants you a personal, limited, non-exclusive, non-transferable right to access and use the Site.

Site Content

All text, graphics, photographs, images, videos, trademarks, logos, sounds, artwork, software, and other materials on the Site, including the design, layout, arrangement, and overall look and feel of the Site (collectively, the “Content”), are owned by, controlled by, or licensed to Esteem and are protected by copyright, trademark, trade dress, and other applicable intellectual property laws.

The Site and its Content are intended solely for your personal, non-commercial use. You may download, print, or store selected portions of the Content only if you:

• use the Content solely for your own personal, non-commercial use;
• do not copy, post, transmit, or distribute the Content on any network, website, or other media; and
• do not modify, alter, remove, or obscure any copyright, trademark, or proprietary notice.

No right, title, or interest in any downloaded Content is transferred to you. Except as expressly permitted above, you may not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works from, or otherwise exploit any Content without Esteem’s prior written consent.

Products, Orders, and Additional Terms

Additional terms and conditions may apply to purchases of products or services, promotions, contests, or other specific features of the Site. Those additional terms are incorporated into these Terms of Use by reference. If there is a conflict between these Terms of Use and any additional terms applicable to a specific feature, product, or service, the additional terms will control for that specific feature, product, or service.

Esteem may change, discontinue, or update any product, service, pricing, description, or other material on the Site at any time without notice. We do not guarantee that product descriptions, pricing, availability, or other Site content will always be complete, current, or error-free.

Privacy

You understand that transmissions over the internet are never completely private or secure. Although we take reasonable steps to protect information submitted through the Site, we cannot guarantee absolute security.

Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, PRODUCTS, SERVICES, AND FEATURES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, ESTEEM DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

ESTEEM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Your use of the Site is at your sole risk. You are responsible for taking any precautions necessary to ensure that any content you obtain from the Site is free of viruses or other harmful code.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESTEEM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT, PRODUCTS, OR SERVICES AVAILABLE THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If, notwithstanding the foregoing, Esteem is found liable to you for any claim arising out of or related to your use of the Site, Esteem’s total liability shall not exceed the greater of:

1. the total fees you paid to Esteem for any Site-related service in the six (6) months preceding the claim; or
2. US$100.00.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Esteem, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Site;
• your violation of these Terms of Use; or
• your violation of any law or the rights of any third party.

Prohibited Conduct and Enforcement

You may not use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site.

Esteem reserves the right, in its sole discretion and without notice, to suspend or terminate your access to the Site if we believe you have violated these Terms of Use, applicable law, or any other policy or agreement related to your use of the Site.

Esteem may disclose information about you if we determine that such disclosure is necessary or appropriate to:

• comply with applicable law, regulation, legal process, or government request;
• enforce these Terms of Use;
• respond to claims that any content or activity violates the rights of others; or
• protect the rights, property, or safety of Esteem, its users, customers, or the public.

Site Changes and Availability

Esteem reserves the right at any time, without notice, to modify, suspend, discontinue, restrict, or terminate the Site, any portion of the Site, or any product, service, feature, or content offered through the Site.

International Use

Esteem operates the Site from British Columbia, Canada. We make no representation that the Site or its Content is appropriate or available for use in every location. If you access the Site from outside Canada, you do so on your own initiative and are responsible for compliance with all applicable local laws.

Any offer for any product, service, or feature made on the Site is void where prohibited.

Export Compliance

You may not use, export, or re-export any Content, product, or service from the Site except as authorized by Canadian law, United States law, and the laws of the jurisdiction in which the Content, product, or service was obtained.

General Provisions

If any provision of these Terms of Use is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms of Use constitute the entire agreement between you and Esteem regarding your use of the Site and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Esteem regarding the Site.

Esteem’s failure to enforce any provision of these Terms of Use shall not be deemed a waiver of such provision or of the right to enforce it later.

These Terms of Use do not create any partnership, joint venture, employment, or agency relationship between you and Esteem.

Mobile Terms of Service

The Esteem Compression Apparel mobile message service (the “Service”) is operated by Esteem Apparel (“Esteem,” “we,” “us,” or “our”). Your use of the Service constitutes your agreement to these mobile terms and conditions (the “Mobile Terms”).

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service after the effective date of any such changes constitutes your acceptance of those changes.

By consenting to Esteem Compression Apparel’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Esteem Compression Apparel at the mobile number you provided, including messages sent through an automatic telephone dialing system or similar technology, even if your number is registered on a federal or provincial/state Do Not Call list.

These messages may include:

• order updates and transactional notifications;
• account alerts and service messages; and
• promotions, special offers, and cart reminders.

Your consent to receive marketing text messages is not a condition of purchase. Participation in the Service is voluntary.

We do not charge for the Service, but message and data rates may apply. Message frequency varies. You are responsible for any charges imposed by your wireless carrier.

You may opt out of the Service at any time by texting STOP to +1 866-726-2214 or by using the unsubscribe link, where available, in a message. You will receive a one-time confirmation message. If you are subscribed to multiple Esteem text message programs, you may need to opt out of each separately.

We may change any phone number or short code used to operate the Service at any time. If we do, we will notify you where required. Wireless carriers are not liable for delayed or undelivered messages.

You agree to provide a valid mobile number. If your mobile number changes, you are responsible for enrolling in the Service again with your new number.

To the fullest extent permitted by law, we are not liable for delayed, failed, or misdirected delivery of information sent through the Service, for errors in such information, or for any actions you may or may not take in reliance on the Service or any information sent through it.

Feedback and Submissions

Any feedback, comments, suggestions, ideas, or other submissions you provide through the Site will be deemed non-confidential and non-proprietary. Esteem will be free to use, reproduce, disclose, and otherwise exploit such submissions without restriction or compensation to you.
